On September 27, 2026, Legislative Decree no. 30/2026 entered into force in Italy. The measure implements Directive (EU) 2024/825 (Empowering Consumers for the Green Transition) and amends the Italian Consumer Code to stop misleading commercial practices. The Legislative Decree implements the European directive and establishes new responsibilities for producers, all stakeholders in the supply chain, and protection consortia, while introducing heavy penalties.
The new regulation prohibits the use of generic slogans such as "green," "eco," or "sustainable" unless supported by demonstrable performance and external certification. It also bans environmental labels lacking independent verification, the boasting of requirements already imposed by law as distinctive features, and claims of "zero impact" or "climate neutrality" based solely on emissions offsetting through carbon credits. Future targets must also be tied to measurable and third-party verified business plans.
The new rules will not be limited to environmental claims; their scope will also encompass information regarding social characteristics, including ethical commitments, such as animal welfare.
One notable aspect of the Italian transposition is the inclusion of live animals among the products covered by the Consumer Code. As a result, commercial communications concerning animals and their characteristics must also comply with the new regulations prohibiting unfair or misleading information practices.
